Metal Recycling Entities and Used Automotive Parts Recyclers Code Update
Our department has been assigned to evaluate and recommend changes to Chapters 11 (Fire Prevention) and 16 (Licenses and Business Regulations) of the Municipal City Code. This assessment will specifically concentrate on Used Automotive Parts Recyclers (UAPRs) and Metal Recycling Entities (MREs) in response to a Council Consideration Request from Council District 5. The main areas of focus are:
- Timeline and process for issuing and resolving citations
- Fines for recurring violations
- Identifying a threshold for triggering heavier enforcement mechanisms until violations and citations are resolved, such as
- Temporarily ceasing operations
- Requirements of fence line air monitors for a limited time
- Removal of non-conforming uses
- Fines to recuperate city services used to address violations and emergencies
The current ordinance was adopted in 2012.
Metal Recycling Entities and Used Automotive Parts Recyclers Code Update - Community Meeting
In-person meeting to inform residents about the council's request and focus areas for the review and update of Chapters 11 and 16 in the City's Municipal Code.
City Council District 5 filed a Council Consideration Request asking our staff to create a stakeholder task force to evaluate and recommend changes to Chapters 11 (Fire Prevention) and 16 (Licenses and Business Regulations). This task force will include representatives from industry and neighborhoods. Support staff from the City of San Antonio, San Antonio Water Systems, and the Texas Commission on Environmental Quality will be on hand.
Metal Recycling Entities (MREs) are defined in Ch. 16-203 as one:
- Acquiring and purchasing scrap, used, or obsolete ferrous or nonferrous metal
- Performing the manufacturing process by which scrap, used or obsolete ferrous or nonferrous metal is converted into raw material products
Used Auto Parts Recyclers (UAPRs) are defined in Cha. 16-186 as one:
- Dismantling and reuse or resale of used automotive parts and
- Safe disposal of salvage motor vehicles or nonrepairable motor vehicles, including the resale of those vehicles
